MUMBAI: Sunday's train accident near Kanpur will be the first case where the optional accident insurance cover sold by IRCTC on its website will come into play . Dependants of those who opted for the cover will be entitled for a compensation of Rs 10 lakh.

In response to a query from TOI, ICICI Lombard General Insurance MD Bhargav Dasgupta confirmed that his company had provided the cover and that the policy did not include the railway's liability towards the victim. Unlike, say , a motor accident third-party liability cover where the insurance company pays on behalf of the vehicle owner, the IRCTC policy is bought by the victims. This means that the railway liability would not be extinguished.
Besides ICICI Lombard, Shriram General Insurance and Royal Sundaram Insurance are the two other companies that have been chosen to provide cover based on their bids. IRCTC distributes the list of passengers among the three companies along with their details.
Dipankar Acharya, country head (affinity and strategic relationships) at Royal Sundaram Alliance, said, "We had received a list of 92 passengers from IRCTC. We managed to identify 54 passengers covered by us who would have been in the train at the time of the accident. Two victims who are covered have already been identified and our people are reaching out to the relatives to settle the claim."
In terms of the policy, victims or their relatives need to provide a report of the railway authority confirming the accident of the train. They also need to provide the railway report carrying details of the passengers declared dead. In the Kanpur incident, however, the insurance companies are taking the initiative to reach out and proactively settle claims.
The compensation will be paid to the chosen nominee while opting for the policy . If no nominee has been selected, claims will be paid to the legal heir according to the succession certificate.

Unlike other insurance its legal now as it was proposed by Railway ministry. They are legally bound to pay not like announcement while any train accident by ministers or railway board.
