Railways on Thursday justified its statement that Thane resident Bhavika Mehta could have avoided the accident, in which she lost her leg while chasing a thief in a train in which she was travelling in 2012, saying it had been made in good faith and that there was no other intention. Railways added that it sympathised with Mehta.
A division bench of justices Abhay Oka and AS Gadkari however, said: "If you (railways) are taking such a stand, then we will have to deal with it."
Railways reiterated that the accident could have been avoided.
Railways had made the statement while opposing a petition filed by Mehta seeking compensation for medical expenses she had incurred after the accident.

The court directed Mehta, represented through advocate Uday Warunjikar, to submit a compliance of the bills and the demands she had made.
On the last occasion it heard the case, the court had rapped railways for taking such a stand. It had said: "Instead of commending her for her brave act, you (railways) are blaming her for trying to fight back a thief on board a train. Are you saying citizens of India should give into the demands of robbers and thieves?"
Mehta was travelling from Amritsar to Mumbai Central in 2012 when she was robbed by a thief on board. When she tried to chase him, the accused pulled her out of the running train, and because of the injuries she had suffered, her leg had to be amputated.
And since she was not able to get medical aid from any nearby railway/civil hospital, she got herself admitted to a private hospital in Chandigarh, and later claimed a compensation of Rs 9 lakh. This was granted. But later she required Rs 5 lakh to fit a prosthetic leg. But railways did not pay this.
Counsel for railways said: "Railway is liable to pay compensation only if it's proved that there was negligence on its part."
The bench will hear the case next on November 27.

MUMBAI: Some major infrastructure projects such as the second international airport for Mumbai in Navi Mumbai and completion of the Rs 9,600-crore trans-harbour link are now on the Maharashtra government's agenda. The government has also given clearance to two new metro railway lines in Mumbai, which will be Metro 5 and Metro 2 lines.
Most of the land required for the Navi Mumbai international airport has been already acquired.About 291 hectares of land is yet to be acquired and talks with owners of this land have reached advanced stages.
But apart from this new airport, there are a few other new infrastructure projects which will revive Mumbai's transport services, are now on state government's agenda.
"The chief minister has given

approval to two new metro lines which will connect central Mumbai to its metropolitan region. One will be between WadalaGhatkopar-Thane and the another between Dahisar-CharkopBandra and Mankhurd.
Apart from that four new flyovers have been approved to decongest the business district of Bandra-Kurla Complex (BKC).
"These decisions were taken at the Mumbai Metropolitan Region Development Authority's ( MMRDA) meeting on Thursday," Dilip Kawathkar, Joint Director of the authority said.
The state government recently gave a presentation to union environment & forests minister Prakash Javadekar, on various infrastructure projects. MoEF clearances for all these projects have been promised.
"Navi Mumbai International airport is mainly on the agenda because by 2019 we expect that Mumbai's Chhatrapati Shivaji International Airport will reach saturation. This airport is cur rently handling over 700 take offs and landings per day. Navi Mum bai airport will be needed to handle the growing air traffic beyond 2020. We will have to connect Navi Mumbai airport by road to south Mumbai and that's why the trans harbour link is crucial," said a se nior official who was present at the presentation.
"This second international air port for Mumbai will have two parallel runways, which will be east west," said the officer.

A former judge of the Mumbai bench of the Railway Claims Tribunal (RCT), S Ananthanarayan, has slammed the railway ministry's plans to tweak compensation rules for accident victims in such a way as to absolve the railways of responsibility if the mishap had something or the other to do with mistake committed by the victim. Ananthanarayan, who retired in September last year as member (Technical) of Mumbai RCT, the country's largest, said tweaking rules would not absolve railways of its responsibility. It was Ananthanarayan's pro-active role that saw railways filing FIRs for the first time ever against fraudulent claims for railway accident compensation.
Why wouldn't it help railways?
"There is a concept of strict liability—case of Rylands vs Fletcher in the law of torts (see box)—where the principle is that if a
...

person creates abnormally dangerous conditions, then he is liable, despite having taken 'all precautions'. The principle also implies that a victim is not liable to take special (elaborate) precautions. Since railways runs carriages at high speed and carry more passengers than the capacity of the coaches permit, and since doors are not kept closed, it is clear that railways has created abnormally dangerous conditions," Ananthanarayan said:
Onus of proving 'adventurism' on railways
Ananthanarayan said passengers are thus entitled to safety, of course, only provided they do not indulge in 'adventurism'. "But liability is first of the railways, and the onus of proving 'adventurism' too is on railways, and not on the victim. It would also be generally impossible for victims to prove that they had taken precautions. This has to be a presumption till proved incorrect," he said.
Bill may not pass muster in parliament
He said the bill (on this) would be contested in parliament and the government would be foolish to push it through. "In fact, the bill should be contested in a court as well even if it gets support in parliament," said the former RCT member.
For paying better compensation
Ananthanarayan, who emphasised the need for better compensation, said: "No doubt, the compensation paid in a year may be Rs 50 to100 crore, but do compare it to the revenue from Mumbai suburban in a year. There are also instances of mercenary advocates profiteering out of the RCT procedure, as well as cases of fraud. Parliamentarians, who are sympathetic to the passengers of Mumbai, also need to make sure that there is swift, exemplary action taken when these come to light," he said.
Rylands vs Fletcher (1868) was a decision by the House of Lords, which established a new area of English tort law. Rylands employed contractors to build a reservoir, playing no active role in its construction. When the contractors discovered a series of old coal shafts improperly filled with debris, they chose to ignore it and continue the work rather than properly blocking it. On December 11, 1860, shortly after being filled for the first time, Rylands's reservoir burst, flooding a neighbouring mine run by Fletcher, causing £937 worth of damage. Fletcher brought a claim under negligence. It led to the famous
'Rylands vs Fletcher' ruling that said: "The person who for his own purpose brings on his lands and collects and keeps there anything likely to do mischief, if it escapes, must keep it at his peril, and if he does not do so, is prima facie answerable for all the damage which is the natural consequence of its escape".
What's tort in law
A tort in common law jurisdictions is a civil wrong that unfairly causes someone else to suffer loss or harm resulting in legal liability for the person who commits the tortious act, called a tortfeasor.

achalam witnessed a fresh bout of protest on Thursday as attempts to resume the construction of the controversy-ridden Railway Overbridge (ROB) were met with stiff resistance.
The protests began around 8.30 a.m. in the morning when a group of about 50-odd people, including women and children, staged a march to the worksite amidst heavy police security and prevented the workers from commencing work. Following this, District Collector M.G. Rajamanickam held a discussion with the protesters.
But the talks failed and the protests resumed by 3 p.m. with more protesters converging at the location. Soon, the police intervened and the work resumed at the eastern end of the bridge after the protesters were forcibly removed from the site. They were released from police custody later in the evening. The police registered a case

against about 60 protesters, including 20 women.
“The decision to restart work on the ROB follows a High Court order and the police will be providing necessary security cover to the construction site and also for the workers. The work has resumed and no interference from outside will be allowed from here onwards,” the Collector said.
According to him, the district administration has assured the protesters that it will expedite payment of compensation to the evictees and that the land of Kattungal temple will not be used for the project. “They, however, are insisting on stopping the work before further discussions, but we are not in a position to permit this,” he said.
A decision on restarting the project, which had come to a standstill two months back, was taken at a high level meeting convened by the District Collector on Monday. The meeting also decided to seek the help of the police force, if necessary, to provide security to the workers.
Meanwhile, the agitators warned of more protests if the authorities attempted to resume the work. “At any cost, we will not let the work resume and are ready to face any consequences,” said Abiju Suresh, general convener of the Janakeeya Samara Samithi, which leads the protests.
