Bharat Earth Movers Limited (BEML) has moved Nagpur bench of Bombay High Court to challenge the rejection of its technical bid to manufacture the Metro coaches for Nagpur Metro Rail Corporation Limited (NMRCL).
A division bench comprising chief justice Manjula Chellar and justice Bhushan Dharmadhikari on Tuesday issued notices to NMRCL, asking it to reply within a week. The court also directed addition of China Railway Rolling Stock Corporation (CRRC), a Chinese state-run company which was awarded the contract, as a respondent.

testing and commissioning of passenger rolling stock (Metro coaches) and training of personnel. The tender conditions included at least 10 years of experience in design and manufacture of metro cars, and established performance and reliability of five years in minimum aggregate of 500 cars. The last condition was the bidder should have successfully undertaken five different contracts in metros, Light Rail Transit (LRT), and suburban and high-speed railways, in at least one country other than its home country.
BEML, a central PSU, contended through counsel Kartik Shukul that it proposed Skoda Electric as subcontractor to supply propulsion system. The Czech giant has been in the field of manufacturing and supplying propulsion systems to metros, trams, LRTs, EMUs since 2003, and supplied over 500 cars, including to metro rails outside its country. Additionally, it had supplied propulsion to 863 metro coaches, of which 149 were outside the Czech Republic.
However, NMRCL had raised some queries, seeking qualification on certain points, like supply of 363 cars for tram and not for LRT. BEML clarified that Skoda had credentials of producing 2,258 cars for 11 contracts across eight countries. It added that tram and LRT were one and the same. The petitioner submitted a letter to NMRCL and Union ministry for urban development to consider Skoda’s experience in trams at par with LRT. It also took up the issue with the ministry’s joint secretary, requesting him to advice the respondent to strictly follow tender clauses.
On September 29, BEML received a communication from NMRCL that its technical bid was disqualified as its subcontract with Skoda didn’t meet the required criteria. The petitioner has approached the judiciary to quash and set aside the decision to disqualify them. The PSU also demanded its tender be reconsidered, and the price bid opened to decide the successful tenderer, and award contract to them. It pressed for staying the entire tendering process and restrain respondents from allotting tender to other bidders.
