I dont think you can approach the court for the rule itself because its the prerogative of railway. There is no law that prevents it from doing so. However you can approach the court if you reached the station in the allowed time window but were stuck in queue and hence could not reach the PRS window in time and hence could not get your refund. I think that can be challenged and IR will have to make provisions for such Waitlisted cases. It seems impractical to expect people to reach the PRS counter within the small time window available to check the chart and then decide on cancellation.

Thanks Bro, I appreciate the concern which you share , it is quite possible people can not cancel ticket within stipulated time , there are lot of people for whom 500 or 1000 rupees matter a lot , so Railways can not just swallow money of poor people / lower middle class persons

Brother I have already consulted practicing lawyer of high court , he also feels no harm in filing case in consumer court , I will just wait for 2 month time and go shead
